3. About these terms
3.1. These terms form part of the Contract. Provisions that refer to Consumers apply only if you are a Consumer.
3.2. The Contract is concluded at a distance, by electronic means, and is governed by the rules set out in section 15. It is not a written (signed) contract. We record the details of your order electronically, and you can access them later in your confirmation email and on your Order page.
3.3. These terms are available in English and Hungarian, and the Contract can be concluded in either language. The Hungarian version of the Website shows the Hungarian text; all other language versions show this English text.
3.4. You can save and print these terms at any time.
3.5. We have not signed up to any code of conduct.
4. Our eSIM plans
4.1. We sell prepaid travel data plans, which we source from an international eSIM supplier. Plans are delivered electronically only; we do not send a physical SIM card or any other goods.
4.2. Plans are data only. They come without a phone number, and you cannot make or receive ordinary calls or text messages on the eSIM. Internet-based apps, such as messaging and internet calling apps, work over the data connection.
4.3. Plans are sold per Destination for 3, 7, 10 or 15 Days. Before you buy, the product page for each Destination shows the main features of the Plan: the Daily allowance, the speed after the allowance is used, the partner networks, the network type, whether hotspot use is allowed, the country where your internet traffic exits (IP address) and the validity.
4.4. Every Day, your Plan gives you a set amount of data at full speed (the Daily allowance, for example 2 GB a day). Once you have used it, speed is reduced to the rate shown on the product page (for example 1 Mbps) until the end of that Day. Hotspot use (sharing your connection with other devices) is allowed where the product page says so. The network type (for example 4G/5G) depends on coverage and your phone.
4.5. What "unlimited" means. Your connection does not stop when you have used your data. Once you have used the Daily allowance, you stay online at the reduced speed until the next Day starts, when your full-speed allowance is renewed. Unused allowance does not carry over to the next Day. A reduced speed of around 1 Mbps is usually enough for maps, messaging and browsing, but not for HD video.
4.6. Networks and coverage. The service runs on local mobile networks in the Destination. Coverage, actual speed and network type depend on the local network, your location, network load and your phone, so we cannot promise a particular speed or coverage everywhere. For technical reasons your internet traffic may exit through another country, shown on the product page, so some websites and apps may see your IP address as being in that country.
4.7. Validity.
- (a) You must first use your eSIM, that is, connect it to a mobile network in the Destination, within 180 days of purchase. If you do not, the Plan expires unused.
- (b) Your Days start when the eSIM first connects to a network in the Destination, not when you buy or install it.
- (c) Once started, Days run consecutively, even if you do not use the eSIM.
- (d) The Plan ends when the number of Days you bought has passed. Plans do not renew automatically and are not subscriptions.
4.8. Family bundles. You can buy up to four eSIMs in one order, one per phone. The discount on the order total is 10% for two eSIMs, 15% for three and 20% for four. Each eSIM must be installed on a different phone, and each eSIM's Days start with its own first connection.
5. Your phone and what you need to do
5.1. You need a phone that supports eSIM and is carrier-unlocked (not locked to one mobile network). To check eSIM support, dial *#06#: if an EID number appears, your phone supports eSIM. The compatibility list on the Website is for guidance only, so please check your phone before you buy.
5.2. You need to:
- (a) install the eSIM, ideally before you travel and over Wi-Fi (installing it does not start your Days);
- (b) when you arrive, switch on the eSIM line, select it for mobile data and turn on data roaming for this line (roaming on the eSIM line costs nothing extra);
- (c) not delete the installed eSIM, because a deleted eSIM cannot be reinstalled;
- (d) for a Family bundle, install each eSIM on a different phone;
- (e) keep your QR code, activation code and Order page link confidential, because anyone who has them can install the eSIM.
5.3. We recommend that you turn off data roaming on your own SIM, as your home provider may charge you for it.
5.4. If you cannot use the Plan because your phone does not meet the requirements in 5.1, or because the steps in 5.2 were not followed, this is not a fault in our service.
6. Placing an order and when the Contract is formed
6.1. You do not need an account to buy.
6.2. To order:
- On the product page for your Destination, choose the number of Days and how many phones (1–4) you need an eSIM for.
- Enter the email address where you want to receive your QR code.
- Tick the mandatory box: "I consent to immediate delivery and acknowledge that I thereby lose my 14-day right of withdrawal." You cannot continue without ticking it.
- Click the "Pay" button, which shows the total amount payable.
- You are taken to Viva's secure payment page, where you pay by card, Apple Pay or Google Pay.
- After successful payment you return to your Order page, where your eSIM appears shortly.
6.3. Correcting mistakes. Until you click "Pay" you can change the number of Days, the number of eSIMs and your email address. The Website warns you if your email address looks invalid and suggests a correction if it spots a likely typo. On Viva's payment page you can still go back before you confirm the payment, and nothing will be charged. If you have entered a wrong email address, please contact us straight away.
6.4. By confirming the payment you place an order with an obligation to pay. The Contract is formed when Viva has approved your payment and our system has confirmed it. If the payment fails or is cancelled, no Contract is formed and you owe us nothing.
6.5. We confirm receipt of your order and the Contract immediately on your Order page, and by email when we send you your eSIM. The confirmation email is a durable medium: it contains the key details of the Contract and confirms the consent and acknowledgement you gave under step 3 of 6.2. The confirmation email also links to these terms. If you do not receive our confirmation within 48 hours of payment, you are released from your order.
7. Price and payment
7.1. Prices are in euros (EUR). The prices shown are the final prices you pay. We do not charge anything on top of the total shown on the product page and on the "Pay" button, such as handling or delivery fees.
7.2. Family bundle discounts (4.8) are applied to the total automatically.
7.3. We may change our prices for future orders. Price changes do not affect Contracts already concluded.
7.4. Payment is made online only, on Viva's secure payment page, by Visa or Mastercard card, Apple Pay or Google Pay. Your card details are handled by Viva; we never see them. Your card issuer may ask you to confirm the payment (strong customer authentication).
7.5. If your card account is not in euros, your card issuer sets the exchange rate and any conversion fee.
7.6. We issue an invoice for every purchase and send it to you electronically, by email.
8. Delivery of your eSIM
8.1. As soon as your payment is confirmed, we make your eSIM available: the QR code and the details for manual installation (SM-DP+ address and activation code) appear on your Order page, and we also email them to you. On iPhone (iOS 17.4 or later) and on some Android phones you also get a one-tap installation link.
8.2. Delivery usually takes a few seconds. If our supplier is delayed in issuing the eSIM, your Order page will tell you, and we will email you the eSIM as soon as it is ready. You do not need to do anything.
8.3. Your Order page link stays valid. Please save it.
8.4. If we cannot provide your eSIM, we will refund the full price to the payment method you used.
9. Your right of withdrawal
9.1. If you are a Consumer, you normally have the right to withdraw from a contract concluded at a distance within 14 days of its conclusion, without giving any reason (section 20 of Hungarian Government Decree 45/2014 (II. 26.)).
9.2. A Plan is digital content not supplied on a tangible medium. For such content, the right of withdrawal does not apply once performance has begun, if you gave your prior express consent to performance starting during the withdrawal period, acknowledged that you would thereby lose your right of withdrawal, and we have confirmed this to you (Article 16(m) of Directive 2011/83/EU; section 29(1)(m) of Decree 45/2014).
9.3. By ticking the box described in step 3 of 6.2, you give this consent and acknowledgement, and we confirm it as described in 6.5. You therefore cannot withdraw from the Contract once your eSIM has been made available to you (8.1).
9.4. Until your eSIM has been made available to you (for example during a delay under 8.2), you may withdraw within 14 days of the Contract being concluded. To do so, send us a clear statement by email (hello@nexuscode.hu) or WhatsApp (+36 30 269 7632). You may use the model form at the end of these terms, but you do not have to. It is enough to send your statement before the deadline. We will refund the full price without undue delay, and no later than 14 days after we are informed of your withdrawal, using the same payment method you used.
9.5. Our voluntary guarantee in section 11 applies in addition to the right of withdrawal.
10. If there is a problem with your eSIM: your legal rights
10.1. We must supply a Plan that conforms to the Contract. If it does not, you have statutory warranty rights under Hungarian law ("kellékszavatosság": sections 6:157 to 6:167 of the Hungarian Civil Code and Government Decree 373/2021 (VI. 30.)).
10.2. You can ask us to fix the problem or to replace your eSIM, unless that is impossible or would cost us disproportionately more than another remedy. If we do not agree to fix or replace it, cannot do so, or you no longer have an interest in it, you can ask for a price reduction or withdraw from the Contract. You cannot withdraw because of a minor defect.
10.3. Please tell us about a problem without delay once you discover it. If you are a Consumer, notice given within two months of discovering the problem always counts as given without delay. A Consumer's warranty claim expires two years after delivery.
10.4. You can report a problem using the contact details in section 13. We bear the costs of putting things right.
10.5. Under Hungarian law, product liability claims against a manufacturer ("termékszavatosság") only apply to physical goods and therefore not to Plans. No mandatory statutory guarantee ("jótállás") applies to Plans.
11. Our money-back guarantee
11.1. In addition to your legal rights, which it does not affect or limit, we give you this voluntary guarantee:
- (a) It works, or your money back. If your eSIM does not work and we cannot fix it, we refund the full price, provided you tell us within 30 days of purchase.
- (b) Refund before installation. If the eSIM has not been installed yet, we refund the full price on request, provided you send your request within 48 hours of purchase.
11.2. For (a), an eSIM "does not work" if it gives you no mobile data connection in the Destination on a compatible, unlocked phone with the settings described in 5.2(b). Please work with us so that we can try to fix the problem.
11.3. For a Family bundle the guarantee applies per eSIM: if only some eSIMs are affected, we refund the discounted price of the affected eSIMs.
11.4. To claim, contact us by email (hello@nexuscode.hu) or on WhatsApp (+36 30 269 7632) with your order number. There are no forms to fill in.
11.5. Once we accept your claim, we will start the refund through Viva to your original payment method within 3 working days. When the money reaches your account depends on your card issuer, usually within a few working days.
11.6. When we refund under (b), we cancel the uninstalled eSIM, after which it can no longer be installed or used.
11.7. Apart from the cases covered by sections 9 to 11, we do not refund unused Days or data, for example if you cut your trip short or do not use the eSIM within 180 days.
12. Our responsibility for loss or damage
12.1. We are responsible under Hungarian law for loss or damage caused by our breach of the Contract, unless we prove that the breach was caused by circumstances outside our control that could not be foreseen when the Contract was made and that we could not reasonably have been expected to avoid or prevent (section 6:142 of the Hungarian Civil Code).
12.2. Nothing in these terms limits or excludes our liability for intentional breach or for breach causing harm to life, physical integrity or health, or affects your statutory rights as a Consumer.
13. Complaints
13.1. You can make a complaint about us or your Plan:
- by email: hello@nexuscode.hu
- on WhatsApp: +36 30 269 7632
- by phone: +36 30 269 7632
Please include your order number.
13.2. We answer written complaints in writing within 15 days, and in any event within 30 days of receipt (section 17/A(6) of Hungarian Act CLV of 1997 on Consumer Protection). If we reject a complaint, we will explain why and tell you which authority or conciliation body you can turn to.
13.3. We look into complaints made by phone straight away. If you disagree with how we handle your complaint, or it cannot be investigated immediately, we will record it with a unique reference number and send you a copy, at the latest together with our reply.
13.4. We keep complaints and our replies for three years.
14. Resolving disputes
14.1. Conciliation bodies. If you are a Consumer, you can ask a Hungarian conciliation body ("békéltető testület") to settle a dispute with us out of court, free of charge. The competent body is the one for your place of residence in Hungary. If you do not live in Hungary, for example because you live in another EU country, it is the body for our registered office. You can also ask for your case to be handled by another conciliation body by naming it in your application. Proceedings are conducted in Hungarian. We are required by law to cooperate in these proceedings.
14.2. Contact details of all Hungarian conciliation bodies: https://bekeltetes.hu
14.3. We have not made a general declaration accepting the decisions of conciliation bodies as binding.
14.4. Help in your own country. If you live in another EU country, the European Consumer Centre in your country (ECC-Net) can help you with a cross-border dispute free of charge.
14.5. Consumer protection authorities. You can also contact a consumer protection authority. In Hungary, the general consumer protection authorities are the metropolitan and county government offices (Government Decree 326/2024 (XI. 14.)).
14.6. Courts. You can also bring a claim in court. If you live in another EU country, you can bring proceedings in the courts of the country where you live (Article 18 of Regulation (EU) No 1215/2012).
15. Which law applies
15.1. The Contract is governed by Hungarian law. If you are a Consumer habitually resident in another country, this choice of law does not deprive you of the protection of the mandatory rules of the law of that country (Article 6(2) of Regulation (EC) No 593/2008, "Rome I").
16. Your personal data
16.1. We use your personal data as described in our Privacy Notice.
17. Other important terms
17.1. We may change these terms. Changes apply to orders placed after they take effect; your Contract is governed by the terms in force when you placed your order.
17.2. If any part of these terms is found to be invalid, the rest remains in force.
